- The Engineering and Construction Contract should be used for Building Works instead of the JCT Conditions. Discuss the merits and disadvantages of this proposal.
- In recent years much has been achieved in valuation procedures to ease contractor’s cash flow problems over payments for work carried out. Research these changes and discuss whether or not they have been successful.
- It is said that the MMHW has played major part in the growth of measurement claims over its lifetime. Discuss giving examples, whether this is a true reflection of the method and consider if the sole use of CESMM for all civil contracts might have been a better way forward.
- Before the introduction of adjudication arbitration was considered a serious route to take and every effort was made to procure a settlement, very much a last resort procedure. Today many professionals feel that adjudication means that many claims progress to this route too quickly without proper consideration of the claim being made of the claim presented. Discuss the argument and it merits.
